Regulatory Tribunal Hearings

OKT represents Indigenous organizations at a wide range of regulatory tribunals. Our lawyers appear before and provide advice on energy and environmental regulatory agencies across Canada, such as the Canadian Environmental Assessment Agency, the National Energy Board, the Canadian Nuclear Safety Commission, public utilities regulators and provincial environmental review boards. We have expertise related to all applicable resource sectors and have appeared at regulatory hearings and judicial reviews of regulatory decisions at various stages of proceedings.

We assist clients at each stage of the proceeding, from seeking standing, to preparing submissions, securing experts and challenging proponent evidence.

 

Our experience includes:

  • Hearings before the National Energy Board with respect to pipeline approvals, including the Energy East Pipeline
  • Advice on and representations to environmental and land use planning tribunals across Canada including: the Mackenzie Valley Resource Management Board and other northern boards, the Manitoba Clean Environment Commission, the Ontario Review Tribunal, and Ontario Municipal Board
  • Appearing before the Canadian Environmental Assessment Agency
  • Appearing before the Canadian Nuclear Safety Commission
  • Representing the Innu Nation before the Newfoundland and Labrador Public Utilities Board for fair electricity rates for their communities
  • Advice and representation on issues related to provincial utilities including rate hearings, license, and other matters
